It\u2019s important that companies stay up to date to avoid lawsuits and fees. <\/span><span style=\"font-weight: 400;\">Warning labels used to only have to say that there were harmful substances in a product. They did not disclose what chemical was being used or what the level of risk was.<\/span><\/p>\n<p>California proposition warning labels now require that consumers be informed of at least one chemical name and the risks it possesses.<\/p>\n<p><span style=\"font-weight: 400;\">Internet sales now must follow the rules of Proposition 65 and warnings must be displayed on the display page of a product before the purchase of the product. However, a substance can be way below the amount required for labeling and a case can still be filed. This causes businesses to spend tons of money in court to prove they are within regulation and defendants usually end up settling to avoid further expenses. <\/span><\/p>\n<p><a href=\"http:\/\/www.latimes.com\/health\/la-he-pro-con2-2009nov02-story.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">In 2008<\/span><\/a><span style=\"font-weight: 400;\">, there was a total of $14.6 million in attorney fees and only $4.6 million in civil penalties as a result of Proposition 65. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">As a result, more and more products have warnings on them, and consumers don\u2019t know what is actually harmful and what isn\u2019t. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">There is also another big flaw in Proposition 65. Since new scientific studies are always being done, the harmful chemical list is continuously growing and changing. <\/span><\/p>\n<\/div><div class=\"fusion-clearfix\"><\/div><\/div><\/div><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-10 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last\" style=\"margin-top:0px;margin-bottom:20px;\"><div class=\"fusion-column-wrapper fusion-flex-column-wrapper-legacy\" style=\"background-position:left top;background-repeat:no-repeat;-webkit-background-size:cover;-moz-background-size:cover;-o-background-size:cover;background-size:cover;padding: 0px 0px 0px 0px;\"><div class=\"fusion-text fusion-text-14\"><p><span style=\"font-weight: 400;\">Constant changes make it hard for companies to update their labels and they may be targeted by a \u201cbounty hunter.\u201d Bounty hunter is a term for people who actively seek out companies that are in violation of Proposition 65. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Although there is a one-year grace period to provide warnings for a new chemical added to the state\u2019s list, companies still have a hard time avoiding bounty hunters.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Take the chemical Cocamide DEA for example. Cocamide DEA is a foaming agent used in shampoos and other related products. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">On the one-year anniversary of Cocamide DEA being added to the chemical list, there were <\/span><a href=\"http:\/\/www.klgates.com\/warning-proposition-65-warning-requirements-have-changed-01-04-2017\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\"><span style=\"font-weight: 400;\">dozens of claims<\/span><\/a><span style=\"font-weight: 400;\"> made by bounty hunters against manufacturers and retailers.
